Terms of Business
Booking a photo-package, or using any booking form on this website, as well as placing an order with Geoff Pegler Photography constitutes an acceptance of our Terms and Conditions.
In order to get the most from our photo-shoots, and to be fair and considerate of others, customers should ensure that they arrive promptly for any booked photo-shoot. If you find out that you are unable to attend a photo-shoot, please let us know immediately by email geoff@geoffpeglerphotography.com or telephone 078697 69 35.
Where a customer conduct is unacceptable (in our reasonable opinion), we reserve the right to end a photo-shoot immediately. No refund of any fees will be made.
Geoff Pegler Photography is entitled to change the location and make minor changes to the timing and content of any advertised photo shoots, courses and classes. In the unlikely event that our photographer (Geoff) becomes unavailable for a photo-shoot, we will make every effort to ensure the replacement with similar expertise is found, or more likely , for shoots that are easily rescheduled, try to reshedule the shoot.
Liability
Please ensure you take care of all your personal possessions whilst on a photo-shoot, or course with Geoff Pegler Photography.We cannot accept any liability for them.
Please note that in the unlikely event of any damage to our customers possessions on a shoot, or at an event or course, like: clothing, computers, laptops, cameras, lenses, and any other goods or materials, whether caused by negligence or otherwise, our maximum liability is limited to the cost of replacement of the item or materials only. No responsibility will be accepted for indirect or consequential loss and ‘sentimental value’ damages, and it shall be the responsibility of the customers / visitors to arrange adequate and appropriate insurance against the risk of any loss or damage.
We will not be liable for any loss or damage suffered by customers resulting from any events which are beyond the reasonable control of Geoff Pegler Photography.
Photo Shoots (Photo Sessions)
Cancellation Policy for Scheduled Photo Shoots
For organizational reasons, we reserve the right to postpone, change the location or reduce the number of hours of any scheduled session if the minimum number of participants have not pre-booked a shoot at the session or in case of Force Majeure. For all cancellations by us, your payment can be fully refunded or used for another course or service.
Cancellation Policy for Private Photo Shoots
If you do not turn up for / at a scheduled shoot, the full fee may still be charged, depending on the nature of the shoot and circumstances for cancellation. Assessment will be made on a case-by-case basis to determine if any transferal or refund is possible, according to the following guidelines:

Short Photo Shoots (up to 1-4 Hours):
​
14 days before the Session: Full refund of any pre-payment or a credit for another photo shoot is possible.
​
Until 7 days before the session: Full credit for another session is possible. Refund: if we fill your place from the standby list / another customer – 100%, otherwise 50%.
​
Less than 7 days before the session: Full credit for another photo shoot is possible only if we manage to fill your slot with another customer photo-shoot. Refund is not possible.
​
3 days or less before the session: In this case, we regret that there will be no refund. It’s only possible to reschedule your participation if you provide us a medical report.
In the unlikely event that we have to cancel or reschedule a course due to tutors illness, absence or in any other circumstances, we will offer a full refund or transfer the registration to another course up to the same value.

Long Photo Shoots (> 4 hours):
​
A deposit or a full upfront payment may be required to guarantee the session in our calendar. Cancellation and reimbursement at the request of the customer are subject to different conditions depending on the type of shoot and the request date. Customers who wish to cancel a booked shoot must contact Geoff Pegler Photography, in wrting or by email at geoff@geoffpeglerphotography.com:

Wedding:

90 days before the wedding: Full refund or a credit for another date is possible
-
Until 30 days before the event: 50% credit is possible, or a reschedule.

Less than 30 days: The customer will remain committed up to 100% of the total contract fee.

Corporate Event:
-
30 days before the event: Full refund or a credit for another date is possible
-
Until 10 days before the event: 50% credit is possible, or a reschedule.
-
Less than 5 days: The customer will remain committed up to 100% of the total contract fee.
Short term illness of the customer that prevent him/her to pursue the photo shoot may qualify the customer for a credit for another session, provided relevant medical documents.
The following exceptions apply:

Permanent long-term illness or disability of the customer, preventing him/her to pursue the session,
-
Death of the customer
-
Death of a close relative, compelling the customer to return with his/her family and support them financially.

In these cases, the customer (or his/her legal claimant) will send a registered letter to Geoff Pegler Photography, containing the relevant certified documents, such as a medical and other certificate. The refund will only concern the fees that have been paid in advance.

Definition of Force Majeure
​
Termination clause in the event of force majeure
In the event of cancellation or change of date prior to phot shoot offered by the Geoff Pegler Photography due to force majeure, Geoff Pegler Photography informs the client of the cancellation and endeavors to offer him a replacement service of same value. If this cancellation concerns only part of the service and does not compromise the entire service, replacement dates or services will then be offered. If the customer agrees to the initial replacement, the amounts already paid in this regard are charged to the price of the new service and any difference is refunded to the customer. If the replacement service is more expensive than that initially contracted, only the price of the latter will have to be paid. If the customer renounces the proposed replacement and terminates the contract, the amounts already paid are returned to the customer. All other claims of the customer are excluded. If a customer cancels their reservation before force majeure occurs, they will not be able to reverse their decision to claim the full refund and will have to pay the applicable cancellation fee.
Gift vouchers / Course Bundles refund policy
Gift Vouchers and course bundles are not refundable (partly or fully). They are not transferrable to anybody else other than the mentioned recipient.

The recipient can use the amount assigned to the gift voucher as a discount, to register for a more expensive photo shoot.
Photo Usage by Geoff Pegler Photography
The customer grants Geoff Pegler Photography an irrevocable, general and unlimited right to use the photo(s) for its marketing and PR work related to SPC Photo Awards, so long as no recognisable persons are included in the photos. This includes the options of reproduction, publication, depiction and distribution for the photo. This permission includes the use of those photos for
-
presentation in exhibitions,
-
publication on the internet and in social networks (which may include adaptation to the format of specific channels; e.g. Instagram, Facebook, Meetup, etc),
-
inclusion in other publications, including publications by third parties in press reports.
Any further commercial use requires the separate consent of the customer.
Cancellations and Refunds:
IF WE CHANGE OR CANCEL A photoshoot
We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes we may contact you via email, telephone, text messages, and postal mail.

We do our best to avoid any cancellations and changed to our scheduled sesions. However, given the long term awareness and ability for customer to book for some trips, this can be sometimes unavoidable. We must therefore reserve the right to cancel or make changes to all our trips. This includes cancellations due to force majeure or under booking. See definitions below. With the exception of force majeure, these changes can be major or minor.
In the case of a major change or cancellation (a major change is defined as a change to accommodation of a lower rating for all of your holiday or a change of holiday dates) we will advise you as soon as possible and we give you the following options:

Accept the new arrangements

In case of an external agency booking is involved: Use your flight and do the trip anyway with the agency and get a partial refund of all payments except the agency fees already paid

Take an alternative holiday subject to availability (if a lower price we will refund the difference; if a higher price you must pay the difference)

Withdraw and accept a full refund of all monies paid (excluding holiday insurance premiums or additional costs we have incurred on your behalf, such as local agency fees)
In the event of a minor change (any change that is not defined as a major change above or force majeure), the above options will not be available to you. Every trip is slightly different when executing, so the descriptions and the schedules on the page are possible to change, many times for your own benefit. We also reserve the right for any reason or at any time, at our sole discretion, to decline to accept or to retain any person on a holiday as a client particularly if their conduct is disruptive and affecting the enjoyment of other participants on the trip, and we shall be under no liability for any costs incurred by such a person as a result of our doing so.
FORCE MAJEURE is the unusual and unforeseeable circumstance beyond our control, the consequences of which neither we or our suppliers could avoid, examples of which are war or threat of war, hostilities, labor conflicts, riots, civil strife, terrorist activity, industrial disputes, natural or nuclear disaster, fire or adverse weather conditions, level of water in rivers, or other similar events beyond our control. In these cases, Swiss Photo Club may cancel the proposed voyage without liability to refund passage money or fares paid in advance.
UNDER BOOKING is the situation in which a minimum number of clients required to operate a photo session is not met. That number is typically about 5 and we may cancel the session in these circumstances. In this instance, you are entitled to receive a full refund for any costs paid to Geoff Pegler Photography (excluding flights or additional costs you have incurred as a result of booking the holiday / trip yourself). Therefore it’s important to wait for our confirmation of the trip before you book your flights or other other expenses such as accommodation, if your participation is based on a Geoff Pegler Photography event alone.
IF YOU CHANGE OR CANCEL YOUR SESSION
If for any reason you decide not to take part in a paid photo session (rather than cancel your booking and incur cancellation charges), you may transfer your booking to another session. All monies due to us at the time of the transfer shall become nonrefundable and may only be used against an alternative session taken within 12 months of the original booked session. Should the total cost of the alternative session be less than the transferred monies no refunds or further transfers will be permitted. The right to transfer is subject to an administrative fee equivalent to 20% of the relevant cancellation charge. This fee is payable within 7 days of receipt of transfer confirmation.

If for any reason you cancel your session after you made your booking via full or partial payment, you must notify us in writing. The cancellation of your session comes into effect upon receipt of the written notification from you.
Four Seasons Membership Packages with Geoff Pegler Photography
Your membership payment entitles you to free photos for 1 year from all Wlakies photo sessions that your dog attends. Your payment does not cover Pack Events, which are offered at a discount based on the level of Four Seassons membership

Refund Policy
​
You are entitled to a full refund during the 14 days after the 1 year package begins, provided you have not downloaded any photos. Please note that this 14-day period commences when the 1 year package term starts. For credit card purchases, your package membership is NOT set to renew automatically at the end of your 1 year membership.
Penalty Fee for Non-attendance / Cancellations of participation in a Pack Event:

Up to 24 hours before the Event: 100% of your ticket fee – ticket not transferable.

Between 25hrs and 72hrs before the event, 25% of your ticket fee – or 100% transferable to another event (once only).

Between 72hrs and 1 week before the event, 50% of your ticket fee – or 100% transferable to another event (once only).

Between 1 week and 2 weeks before the event, 25% of your ticket fee – or 100% transferable to another event (once only).

More than 2 weeks before the event: No penalty
Third Party Payment Services
Geoff Pegler Photography uses Wix Payment Services & Paypal Inc as third party service providers for payment services. By using the Site, you also agree to be bound by their Terms of Service.

You hereby consent to provide and authorise Geoff Pegler Photography, Wix and Paypal to share any information and payment instructions you provide to the extent required to complete the payment transactions in accordance with the Terms, including personal, financial, credit and debit card payment, and transaction information.

We reserve the right to modify these terms and conditions at any time, so please review them frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to our Terms and conditions, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
